RENTAL CONDITIONS

GENERAL RENTAL CONDITIONS FOR SKI AND SNOWBOARD EQUIPMENT

IMPORTANT: Read these conditions carefully before confirming your reservation. By making the payment, you fully and unreservedly accept these General Rental Conditions.

1. Purpose of the Contract

This contract regulates the provision of sports equipment rental services offered by Pic Negre in:

  • Ski and snowboard equipment.
  • Cycling equipment: bicycles, electric bikes (e-bikes), and mountain bikes.
  • Mountain gear: child carrier backpacks, trailers, poles, protections, and other accessories.

The characteristics, categories, and availability of the equipment will be described on the Pic Negre website and visible at the physical stores where the service is provided.

3. Reservation Conditions

3.1. The reservation will be valid once the process is completed on the website or at the store, including the explicit acceptance of these conditions and the full payment of the service.

3.2. The client affirms having read, understood, and accepted these general conditions, available on the website and visible in-store.

3.3. The client agrees to provide truthful and complete data during the reservation.

3.4. Online prices may be lower than in-store prices. There are no intermediaries or additional management costs when booking online.

4. Online Reservation Process

To make a reservation you must:

  1. Select the store where you wish to collect the equipment.
  2. Choose the dates and duration of the rental.
  3. Select the equipment according to skill level, size, or specific needs.
  4. Make the payment using the available methods.
  5. Download and print the reservation voucher that will be sent by email and present it in-store.

5. Prices and Payment

5.1. Prices are public and detailed in the Rates section of the website and at Pic Negre stores.

5.2. Payment will be made to Pic Negre by bank card.

5.3. Financial expenses, commissions, or surcharges arising from the use of cards issued outside the country will be borne by the client.

5.4. Banking details are encrypted and do not transit through Pic Negre's systems; the company does not store or manage client banking information.

5.5. The reservation is considered final after effective payment and receipt of the confirmation email which includes the collection voucher.

6. Rental Duration and Equipment Collection

6.1. The rental begins upon collection in-store and ends on the day the equipment is returned.

6.2. Collection can be done from the store opening time on the rental start date.

6.3. A credit/debit card or identification document may be requested as a security deposit.

6.4. The equipment must be returned to the same store where it was collected, in the same condition in which it was handed over.

6.5. Failure to return on the agreed date may generate additional charges equivalent to extra rental days.

7. Use of Equipment

7.1. The use of the rented equipment is personal and non-transferable.

7.2. The client declares having checked the condition of the equipment upon collection and acknowledges that it is delivered in optimal condition.

7.3. It is prohibited to modify, manipulate, or substitute components of the equipment without authorization (includes ski binding adjustments).

7.4. Prohibited use of e-bikes and enduro bikes on downhill (DH) circuits, such as Bike Parks. Non-compliance entails a penalty of €300.

7.5. Misuse of the equipment will result in a charge equivalent to the cost of repair or replacement.

7.6. Loss, theft, or severe damage to the equipment will oblige the client to pay the replacement value, unless they have a purchased warranty or insurance that covers such incidents.

8. Cancellations and Modifications

8.1. The client may cancel their reservation up to 48 hours before the start of the rental and will receive a full refund using the same payment method.

8.2. In duly justified cases of force majeure (accident, illness…), a proportional refund for the unused days will be calculated.

8.4. After approval of the cancellation, the refund will be made within an estimated period of 3 to 4 working days, which may vary depending on the banks involved.

9. Client Responsibility

9.1. The client is responsible for the equipment from the moment of its collection until its return.

9.2. The client will be responsible for any costs arising from loss, theft, damage, or misuse not covered by a purchased warranty.

9.3. The client may not substitute the equipment for another without the store's express authorization.

9.4. The client agrees to return the equipment within the agreed period and in its original condition.

10. Limitation of Liability

10.1. Pic Negre shall not be liable for personal injuries, accidents, or losses suffered during the use of the rented equipment, except for defects attributable to the equipment itself.

10.2. The client declares having the experience, physical capacity, and knowledge necessary to use the rented equipment safely.

10.3. The use of sports equipment involves inherent risks which the client assumes under their entire responsibility.

11. Personal Data Protection

11.1. The personal data collected will be used to manage the reservation and, unless expressly opposed, for Pic Negre's commercial communications.

11.2. The client can exercise their rights of access, rectification, cancellation, and opposition via email info@picnegre.com.

11.3. Data processing is carried out in accordance with the regulations in force in Spain and the entire European territory.

12. Legal Notice and Information Update

12.1. Pic Negre shall not be responsible for errors, inaccuracies, or omissions in the information contained on the website or informational materials.

12.2. Pic Negre may modify, update, or correct the information at any time without prior notice.

12.3. The client agrees not to use the website for illegal, defamatory, or public order-violating activities.

13. Pic Negre Warranties

13.1. Pic Negre markets its own warranties for rental equipment (ski, snow, accessories, clothing, bicycles) to cover possible unforeseen events such as breakage or loss. Through these warranties, the amount the client must contribute in case of breakage, loss, or theft of the rented equipment is reduced.

13.2. Each purchased warranty is associated with a specific rented item.

13.3. The price of each warranty may vary depending on the type and/or range of the equipment, will be available through all communication and customer service channels, and will always be visible to all clients in stores.

13.4. The warranty must be purchased prior to the equipment handover. The equipment rental may have been reserved online and the warranty purchased in-store, having the same validity as if it had been purchased together with the equipment online.

13.5. The warranty covers 100% of the equipment value in case of breakage. In case of theft or loss, the warranty covers 50% of the equipment value.

13.6. If no warranty has been purchased, in case of breakage, theft, or loss, 100% of the total equipment value must be paid.

Important:

  • With purchased warranty: In case of breakage of the equipment, the client does not have to pay any additional amount (0€). In case of loss or theft, the client will pay 50% of the equipment value (according to the "With Warranty" column).
  • Without warranty: The client must pay 100% of the equipment value in case of breakage, loss, or theft (according to the "Without Warranty" column).

14. Acceptance of the General Conditions

By completing the reservation process and clicking the Accept button, the client expressly and unequivocally declares that they have read, understood, and accepted these General Rental Conditions.
